If you manage a commercial facility, a strata complex, or an industrial site, you likely have a Gross Pollutant Trap (GPT) underground. Most Facility Managers know it’s there, but few understand the strict legal liabilities attached to it.
A GPT is not just a drain. It is a licensed environmental protection device. Its sole purpose is to stop your site from polluting the public waterways.
When a GPT is neglected, it doesn’t just block; it bypasses. This means every plastic bottle, oil slick, and kilogram of sediment from your car park flows directly into the local creek or harbour. Under Australian environmental law, the asset owner is strictly liable for this pollution.

What is a Gross Pollutant Trap (GPT)?
Think of a GPT as the “kidneys” of your stormwater system. It is a primary treatment device installed at the bottom of your catchment (usually just before the water leaves your boundary) to filter out physical contaminants.
While designs vary (from simple concrete pits with trash screens to complex vortex separators like Humeceptors or CDS units), they all target three main pollutants:
- Gross Pollutants: Litter, plastic bottles, plastic bags, and vegetation (leaves/branches).
- Sediment: Sand, dirt, and construction dust (Total Suspended Solids).
- Hydrocarbons: Free-floating oils and grease (often from car park runoff).
How Do They Work? (And Why “Bypass” Matters)
Most GPTs use physical barriers (screens) or hydrodynamic separation (spinning water to drop solids out).
Crucially, almost all GPTs are designed with a High-Flow Bypass.
- Normal Flow: Water goes through the filter/screen, and pollutants are trapped.
- Storm Flow: When the flow exceeds capacity (or if the trap is full), water flows over a weir, bypassing the filter to prevent upstream flooding.
The Danger: If your GPT is full of silt because it hasn’t been cleaned in 12 months, it enters “Permanent Bypass.” It offers zero environmental protection. You are effectively discharging raw pollution into the environment every time it rains.
Your Legal Duty: It’s Not Optional
In Australia, stormwater pollution is governed by strict state-based legislation (e.g., the Protection of the Environment Operations Act 1997 in NSW).
1. “Strict Liability” for Pollution
You do not have to intend to pollute to be fined. If pollutants leave your site and enter a waterway because your GPT was full or broken, you are liable. “I didn’t know it was full” is not a legal defence.
2. Positive Covenants (Title Obligations)
Most modern developments have a “Positive Covenant” or “Restriction on Use” registered on the land title regarding the stormwater system. This is a binding legal contract with the Local Council that legally obliges the owner to:
- Keep the system in good repair.
- Conduct regular inspections (usually 6-monthly).
- Provide evidence of maintenance upon request.
3. EPA Clean-Up Notices
If a pollution event is traced back to your site, the EPA or Council can issue a Clean-Up Notice. This forces you to pay for the environmental remediation of the local waterway—a cost that can run into the hundreds of thousands, far exceeding the cost of a cleaning truck.
The Maintenance Reality: It’s Not a Handyman Job
You cannot clean a GPT with a shovel.
- Confined Space: GPTs are deep underground. Access requires certified Confined Space Entry (CSE) teams with tripods, harnesses, and gas detectors.
- Contaminated Waste: The sludge at the bottom of a GPT is often classified as contaminated waste (containing heavy metals and hydrocarbons). It must be extracted by a vacuum truck and disposed of at a licensed liquid waste facility with tracking receipts.
Summary
A GPT is an asset that exists to manage your environmental risk. If you ignore it, that risk falls squarely on you.
A regular, programmed cleaning schedule is the only way to ensure your “kidneys” are working and your site remains compliant with the EPA and Council.
